The Grape Defeats Katz (At Last!)

from the Zero list: June 12th, 2002 ... It's Official! Moby Grape has won a major victory against Matthew Katz!. The following cases have been ordered dismissed by San Francisco Superior Court judge James Robertson. The order of dimissal has been uploaded to the file area of Moby Grape's Yahoo! group. If you'll recall, back in 1997, the Grape won a major victory in the California Court of Appeals that affirmed the lower Superior Court ruling from a couple years earlier. This was posted on the website as well as appearing in the newspapers. Within a couple months, Katz filed a brand new "trial de novo" lawuit in Los Angeles and a series of counter suits ensued for the next five years, including defamation suits. Grace Slick, major newspapers, webmasters, Herbie Herbert, the attorneys and many others were sued by Katz. Katz was countersued by the band and this resulted in 5 separate lawsuits that were consolidated into one suit a few months ago in San Francisco Superior Court. Because Katz was unable to bring this to trial within 5 years, the whole thing was thrown out last week. This was partly because of some of the musicians, such as JA Miller's refusal to go a long with a settlement which was part of the consolidated cases. While it is possible for Katz to try and start this up again, it's unlikely, because there is not much left here anymore. There is "no there, there."
